1. Who we are
The online store Dahlia (dahlia.ro) is operated by Edelnova Studio SRL, with its registered office at Piața Eroilor no. 9, 515100 Abrud, Alba County, registered at the Trade Registry under no. J2026044951007, CUI 55238108, share capital 500 lei.

Edelnova Studio SRL acts as a merchant (direct seller of products to the end consumer). We are not a marketplace, intermediary, distributor, or agent.
2. Definitions
"Seller" or "we": Edelnova Studio SRL, which operates the Dahlia brand.
"Client" or "you": the natural or legal person who places an order on the site.
"Site": dahlia.ro and all associated subdomains.
"Products": the clothing items and accessories offered for sale on the site.
"Order": the request to purchase one or more products, completed on the site.
"Distance contract": the contract concluded between the Seller and the Client via the site, without the simultaneous physical presence of the parties, in accordance with GEO 34/2014.
3. Contractual documents
By placing an order on the site, you expressly accept these Terms and conditions, the Privacy Policy, Cookie Policy, Return Policy, and delivery terms. These documents, together with the order confirmation, form the distance contract between you and us.
4. Products and prices
We present the products as accurately as possible (description, composition, sizes). There may be slight differences in shade depending on your screen, without these constituting a lack of conformity.
Prices are displayed in lei (RON) and include all applicable taxes. The valid price is the one displayed on the site at the time of placing the order. In the case of discounted products, the previously displayed price represents the lowest price practiced in the last 30 days before the application of the discount, in accordance with Law 148/2023 (Omnibus Directive).
We reserve the right to change prices at any time, without prior notice. Changes do not affect orders already confirmed.
5. The order
The order is considered placed after going through the steps on the site and its confirmation. You will receive a confirmation email on a durable medium, in accordance with GEO 34/2014. The distance contract is concluded in Romanian at the time of order confirmation by us.
You can cancel or modify the order (delivery address, products, payment method) before shipment by contacting us at office@dahlia.ro. After shipment, modifications are no longer possible, and the right of withdrawal described in section 8 applies for returns.
If a ordered product is no longer available, we will notify you as soon as possible and refund the full amount paid.
Right to refuse or cancel an order. We reserve the right to refuse or cancel an order in the following situations: the product is no longer in stock; the price displayed on the site contains an obvious error (system error, typo); the data provided by the Client is incomplete or incorrect; the payment cannot be processed or is rejected; there are reasonable suspicions of fraud or abusive use; the Client has repeatedly violated these Terms in previous orders. In any of these cases, we will notify you and refund the full amount paid, if applicable.
6. Payment
We accept online card payment and cash on delivery, paid in full to the courier upon delivery. Card payments are securely processed via Shopify Payments; we do not store or have access to your card details. If you choose cash on delivery, any cash-on-delivery fee is displayed before you complete your order.
Payment is considered made when the amount is confirmed in our account (for card payment) or at the time of paying cash on delivery.
If the card payment cannot be processed or is rejected, the order will not be confirmed. We will notify you to choose an alternative payment method or to retry the transaction.
7. Delivery
We deliver via express courier, within Romania, within the estimated time displayed at order (usually 1–3 business days from shipment). Delivery costs are displayed before finalizing the order.
The risk of loss or damage to the product passes to you when you or a person designated by you enters into physical possession of the products.
Please check the package upon receipt. If you notice visible damage to the packaging, you have the right to refuse the package or mention the problem in the delivery report.
Proof of delivery. Confirmation of delivery by the courier (electronic signature, confirmation code, or any other form of confirmation used by the courier) constitutes proof of receipt of the package by the Client or the person designated by them.

8. Right of withdrawal (14 days)
According to GEO 34/2014 (transposition of Directive 2011/83/EU), you have the right to withdraw from the contract within 14 calendar days of receiving the products, without citing a reason and without penalties. The withdrawal period expires after 14 days from the day you enter into physical possession of the products.
To exercise your right, fill out the Withdrawal Form available on the site or write to us at office@dahlia.ro. You will receive confirmation of the withdrawal via email, in accordance with GEO 18/2026.
Important: returning products without prior notification to the Seller (via the withdrawal form or email) may delay processing and refunding. Please contact us before shipping the return package.
Condition of products upon return. Products must be returned in their original state, within a maximum of 14 days of communicating the withdrawal decision. Specifically, products must be: unworn (except for trying them on, as you would in a physical store), unwashed, and unironed; without traces of perfume, deodorant, foundation, self-tanner, or other substances; without pulled threads, torn seams, stains, or damage; with all original labels attached, including the Dahlia security tag fastened around the piece (details in the Return Policy); in their original packaging or in appropriate packaging that protects the product during transport.
Checking returned products. We reserve the right to inspect returned products. According to Art. 14 par. (2) of GEO 34/2014, the Client is liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products. If the returned products show clear signs of wear, use, damage, or missing labels, we reserve the right to deduct the value of the diminution from the refunded amount.
The refund of the amount paid (including the cost of standard initial delivery) is made within a maximum of 14 days from the date we were informed of your withdrawal decision, using the same payment method used for the initial order. We may delay the refund until receipt and verification of the returned products or until proof of shipment is received, whichever comes first.
The direct cost of returning the products is borne by you, according to Art. 13 of GEO 34/2014. Products must be shipped via a courier service with a tracking number (AWB). The risk of loss or damage to products in return transport belongs to the Client until the moment the package is received by the Seller.
Exceptions to the right of withdrawal (according to Art. 16 of GEO 34/2014): products made to your specifications; sealed products that cannot be returned for hygiene reasons, if the seal was broken after delivery.
Product exchange. Exchange (different size, different color) is not a legal obligation, but we can offer it on a case-by-case basis. If you want an exchange, contact us at office@dahlia.ro before returning the product. In the absence of an exchange confirmation from us, the return is processed as a standard withdrawal with a refund.

9. Legal guarantee of conformity
Products benefit from a legal guarantee of conformity of 2 years from delivery, in accordance with GEO 140/2021. If the product shows a lack of conformity in the first 2 years, you have the right to free repair or replacement. If repair or replacement is not possible or is not done within a reasonable time (maximum 15 days), you can request a proportional price reduction or termination of the contract.
10. Acceptance of products
Products are considered accepted by the Client at the moment they or the person designated by them enters into physical possession of the package, except in cases where the Client exercises the right of withdrawal or invokes the legal guarantee of conformity within the terms provided by law.
11. Seller's obligations
We commit to delivering products conforming to the description on the site, to respect estimated delivery times, to issue tax documents for each order, to respect your right of withdrawal and legal guarantee of conformity, and to process your personal data in accordance with GDPR.
12. Client's obligations
By placing an order, you undertake:
To provide correct and complete data (name, delivery address, phone, email). The Seller is not responsible for failed or delayed deliveries due to incorrect or incomplete data provided by the Client.
To check the package upon receipt, in the presence of the courier, and to immediately signal any visible damage to the packaging.
To ensure your availability or that of a designated person at the delivery address, during the interval communicated by the courier. If the package cannot be delivered due to your unavailability and is returned to us, the transport costs (outbound and return) are borne by you. We will resume delivery only at your express request and after payment of new transport costs.
To pay the amount due upon delivery if you chose cash on delivery. Unjustified refusal to pay equates to order cancellation, and transport costs (outbound and return) are borne by you.
To periodically check your email inbox (including the Spam/Junk folder) for communications related to the order (confirmation, shipment, delivery).
To respect the return conditions described in section 8, including the state of the products and applicable deadlines.
To use the products according to their purpose and to respect the care instructions on the label.
13. Commercial communications
If you subscribe to our newsletter or if you check the option to receive commercial communications, we will occasionally send you information about new products, offers, and Dahlia news. We process your data based on your consent (Art. 6 par. 1 lit. a of GDPR).
You can unsubscribe at any time, through the unsubscribe link in every email or by writing to us at office@dahlia.ro.
14. Intellectual property
The texts, images, logo, design, and visual identity of Dahlia are protected by Law 8/1996 on copyright and belong to us. They cannot be copied, reproduced, distributed, or used without our prior written consent.
Products purchased from the site are intended exclusively for personal use. Resale, commercial distribution, or use of products for commercial purposes without our written consent is prohibited.
15. Limitation of liability
We make every effort for correct and updated information on the site. Our contractual liability is limited to the value of the order in question.
We are not responsible for:
Temporary interruptions of the site due to causes independent of us (scheduled maintenance, cyberattacks, hosting provider problems, force majeure).
Delays in delivery caused by the transport courier, unfavorable weather conditions, or the provision of incomplete or incorrect delivery data by the Client.
Wrong size choice by the Client. We recommend consulting the size guide available on each product page before placing an order. Choosing an unsuitable size does not constitute a lack of conformity of the product.
Deterioration of products caused by failure to follow the care instructions on the label (washing, ironing, drying) or by normal wear and tear resulting from use.
The content of third-party sites accessible through links on our site.
Allergic reactions or sensitivity to materials. The composition of each product is displayed on the label and on the product page on the site. Please check the composition before purchase, especially if you have known sensitivities or allergies to certain textile fibers or substances. Dahlia is not responsible for allergic reactions or irritations caused by product materials, provided the composition was correctly and completely declared.
16. Force majeure
Neither party is responsible for non-execution or delayed execution of contractual obligations if this is due to an event of force majeure, according to current legislation.
Cases of force majeure are considered, without being limited to: natural disasters (earthquakes, floods, fires), epidemics or pandemics, armed conflicts, acts of terrorism, decisions of public authorities that prevent contract execution, major disruptions of transport or telecommunications networks, general strikes.
The party affected by force majeure will notify the other party within a reasonable time and will make every effort to limit the effects of the event.
17. Data protection
We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR). Full details in the Privacy Policy and Cookie Policy.

19. Applicable legislation
These conditions are governed by Romanian legislation. Relevant laws: GEO 34/2014 (consumer rights at a distance), GEO 140/2021 (conformity guarantee), GEO 18/2026 (digital withdrawal form), Law 365/2002 (electronic commerce), GO 130/2000 (consumer protection for the sale of products and services), Law 148/2023 (Omnibus Directive, displaying reduced prices), Law 8/1996 (copyright), Regulation (EU) 2016/679 (GDPR).
20. Amendments
We may update these terms. The applicable version is the one published on the site on the date of your order placement.
21. Electronic correspondence
Communications sent via email between the Client and the Seller constitute correspondence on a durable medium within the meaning of GEO 34/2014 and may be used as a means of proof in the event of a dispute, in accordance with the legislation on electronic documents (Law 365/2002).
22. Severability clause
If a clause in these Terms and conditions is declared null or unenforceable by a competent court, the other clauses remain fully valid and applicable. The affected clause will be interpreted or replaced with a provision as close as possible to the original intention of the parties, to the extent permitted by law.
